1. Introduction & Acceptance

Welcome to pollin8. These Terms of Service ("Terms") govern your access to and use of the pollin8 platform, including our website, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In that case, "you" and "your" will refer to that organization.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

pollin8 is an Instagram engagement platform that helps marketing agencies and professionals find engagement opportunities on Instagram. The Service includes:

  • Instagram hashtag search and management tools
  • AI-powered post analysis and classification
  • AI-generated comment suggestions
  • Scan reports and analytics
  • Team collaboration features
  • Email and Slack notification integrations

The Service is designed as a research and engagement tool. Users are responsible for all actions taken on Instagram, including posting comments.

3. Account Terms

To use the Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

You may not share your account credentials with others or allow multiple individuals to use the same account, except through our team member features. Each organization should maintain a single account.

4. User Content & Conduct

Your Content: You retain all rights to content you provide to the Service, including hashtag configurations, AI settings, and any text you input. By using the Service, you grant pollin8 a limited license to use, store, and process your content solely for the purpose of providing the Service.

Acceptable Use: You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe on the rights of others
  • Send spam, harass, or abuse other users on any platform
  • Attempt to gain unauthorized access to any systems or data
  • Interfere with or disrupt the Service or servers
  • Use the Service for any automated engagement on Instagram (likes, follows, automated comments)
  • Circumvent any rate limits or restrictions imposed by the Service or Instagram

Your Responsibility: You are solely responsible for any content you post on Instagram using suggestions from the Service. AI-generated suggestions should be reviewed and edited before posting.

5. Third-Party Services

The Service integrates with third-party platforms, including but not limited to:

  • Instagram/Meta: For accessing public post data and account information
  • Stripe: For payment processing
  • Clerk: For authentication services
  • Anthropic: For AI analysis capabilities

Your use of these integrations is subject to the respective third-party terms and policies. pollin8 is not responsible for the availability, accuracy, or actions of third-party services.

Instagram Terms: By connecting your Instagram account, you agree to comply with Instagram's Terms of Use and Community Guidelines. pollin8 uses only official Instagram APIs and does not engage in scraping or unauthorized data collection.

6. AI Services

The Service uses artificial intelligence to analyze posts and generate comment suggestions. Please note:

  • AI suggestions are recommendations only and should be reviewed before use
  • AI may produce inaccurate, inappropriate, or irrelevant results
  • You are responsible for the final content you post on any platform
  • AI analysis is based on publicly available information
  • We do not guarantee any specific engagement results from using AI suggestions

7. Billing & Payment

Pricing: The Service is billed per connected Instagram account. Current pricing is available on our pricing page. Prices may change with 30 days' notice.

Free Trial: New accounts receive a 14-day free trial with full access to features. No credit card is required to start a trial.

Billing Cycle: Subscriptions are billed monthly or annually, depending on your chosen plan. Billing begins when you add a payment method after your trial ends.

Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime from your account settings.

Refunds: We offer a full refund within 7 days of your first payment if you're not satisfied. After that, no refunds are provided for partial billing periods. Cancelled subscriptions remain active until the end of the current billing period.

8. Intellectual Property

Our Property: The Service, including its design, features, code, and content (excluding user content), is owned by pollin8 and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

Your Property: You retain all rights to your content. We do not claim ownership of any content you provide to the Service.

Feedback: If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without compensation or attribution.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • The Service will meet your specific requirements
  • Any engagement or growth results will be achieved

We are not responsible for any actions taken by Instagram or Meta regarding your account, including account suspension or termination.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLLINATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

By You: You may cancel your subscription and terminate your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason with reasonable notice. In cases of severe violations, we may terminate immediately without notice.

Effect of Termination: Upon termination, your right to use the Service ends immediately. We may delete your data after termination, though we may retain certain information as required by law or for legitimate business purposes.

12. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Arbitration: Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association. The arbitration shall take place in Delaware or remotely.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or class arbitrations.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

14. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and pollin8 regarding the Service.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
